Right of Withdrawal for Consumers

A consumer is any natural person who enters into a legal transaction for purposes that predominantly cannot be attributed to their commercial or self-employed professional activity.

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day

  • on which you, or a third party designated by you who is not the carrier, take(s) possession of the goods, provided that you have ordered one or more goods as part of a single order and the goods are delivered as a single shipment;

  • on which you, or a third party designated by you who is not the carrier, take(s) possession of the first goods, provided that goods are delivered as part of an order for regular delivery over a specified period of time.

You may use the attached model withdrawal form for this purpose, but this is not mandatory.

You may also exercise your right of withdrawal online using a suitably designated button ("Withdraw from contract" or a similar designation) on our website (interosa.de). If you use this online function, we will immediately send you confirmation of receipt of the withdrawal on a durable medium (e.g. by email), including information about the content of the withdrawal declaration and the date and time it was received.

You may also complete and submit the model withdrawal form or another clear statement electronically on our website (interosa.de). If you make use of this option, we will immediately send you confirmation (e.g. by email) that we have received your withdrawal.

To meet the withdrawal deadline, it is sufficient for you to send the notification concerning the exercise of your right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments we have received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event no later than 14 days from the day on which we received notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any event no later than 14 days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of 14 days has expired. You shall bear the direct costs of returning the goods.

You shall only be liable for any diminished value of the goods if this diminished value results from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusions and Reasons for Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts

  • for the supply of goods that are not prefabricated and for which an individual choice or decision by the consumer is decisive for their manufacture, or which are clearly personalised to meet the consumer's personal requirements;

  • for the supply of goods that may deteriorate quickly or whose expiry date would be quickly exceeded;

  • for the supply of alcoholic beverages, the price of which was agreed upon at the time the contract was concluded, but which cannot be delivered until at least 30 days after conclusion of the contract and whose current value depends on fluctuations in the market over which the trader has no control;

  • for the supply of newspapers, journals or magazines, with the exception of subscription contracts.

The right of withdrawal expires prematurely in contracts

  • for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery;

  • for the supply of goods if, after delivery, they become inseparably mixed with other goods due to their nature;

  • for the supply of audio or video recordings or computer software in a sealed package, if the seal has been removed after delivery.
